Survey: what do you think of this case in the news?

It was in the news recently that police in Tennessee arrested a man for using Photoshop to copy and paste the heads of three underage girls (including Miley Cyrus) onto photos of nude bodies of adult women. (The defendant has already admitted to doing this.)

The District Attorney is accusing the man of violating a Tennessee sex crimes law which says in part:
"It is unlawful for any person to knowingly possess material that includes a minor engaged in (1) Sexual activity; or (2) Simulated sexual activity that is patently offensive."

The District Attorney said in a statement to the press: "When you have the face of a small child affixed to a nude body of a mature woman, it's going to be the state's position that this is for sexual gratification and that this is simulated sexual activity."

I'm conducting a survey to see what regular people think. Based on your reading of the law, and based on the description of what the defendant did, do you think he violated the law in question?
